These Terms of Service ("Terms") govern your access to and use of Dispatch Maxx ("Service"), operated by Dispatch Maxx ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Dispatch Maxx is a Software-as-a-Service (SaaS) platform designed for car hauling and trucking dispatch companies. The Service includes a web-based dispatcher dashboard, a driver mobile application, and AI-powered Bill of Lading (BOL) document management tools.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your company. By using the Service, you represent that you meet these requirements.

3. Account Registration

To use the Service, you must register for an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

4. Subscription and Payment

Access to Dispatch Maxx requires a paid subscription at $30 per active driver per month. For example, a company with 5 active drivers is billed $150/month. Payments are processed by Paddle, our authorized payment provider. By subscribing, you authorize us to charge your payment method on a recurring monthly basis based on the number of active drivers in your account.

Your subscription will automatically renew each month unless cancelled prior to the renewal date. We reserve the right to change pricing with at least 30 days' notice.

5. Refund Policy

All payments are non-refundable. We do not offer refunds or credits for partial months of service, unused time, or any other reason. Please refer to our Refund Policy for full details.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit fraudulent, misleading, or harmful content
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, and logos — are owned by Dispatch Maxx and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of any data you upload to the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may cancel your subscription at any time through your account settings or by contacting us. Upon termination, your access to the Service will cease at the end of the current billing period.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Dispatch Maxx shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page or by sending an email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
